General Terms

These terms of use govern the use of our website and mobile application (collectively called the “Platform”) and define the legally binding terms on which you access, browse, register or otherwise use the Platform to enjoy our services. The terms of use apply to all “Users” of the Platform including guest Users.
• b. By using our Platforms in any manner, you confirm that you accept these terms of use and that you agree to comply with and be bound by them.
• c. You understand that a breach of any of these terms of use may result in your rights to use the services on the Platform being restricted, suspended or withdrawn.
• d. We may amend these terms of use at any time by amending this page. Please check this page from time to time to take notice of any changes we make as they will be binding on you. If you are an existing User, we will duly inform you of any amendments that are made, by sending a prompt on the mobile application.
• e. If you do not agree to these terms of use, please do not access this Platform or use the services.

1. Who We Are

Pharmora is an online pharmacy delivery platform in Nigeria. We connect customers (you) with licensed pharmacies (vendors) to deliver medicines and health products quickly and safely.

2. What We Do

Pharmora helps you:

• Browse and order medicines and health products online.
• Get your prescriptions filled by licensed pharmacies.
• Receive delivery at your doorstep.
• Access verified and accurate health information.

3. Who Can Use Pharmora (Rules of Registration and Access)

To use Pharmora:

• You must be 18 years or older.
• You must provide accurate personal information.
• In order to create an account, you must provide a full name, email address, telephone number, and delivery address. A one-time password will be provided to the User upon signing up. It is at this point that you are required to tick a box to confirm to agree with our terms of use and privacy policy
• The information submitted to create or update an account constitutes proof of your identity. We reserve the right to verify, at any time the accuracy of the information provided and to ask you for any additional documentation for the purpose of identity verification.
• If ordering for a child or dependent, you must be their parent or legal guardian.
• Once you create an account, you will be able to select pharmacies of your choice, order your OTC Pharmaceuticals and request that a Pharmora delivery partner get them delivered to the registered address provided to us.
• You can decide at any time to terminate your account, in which case your details will be deleted from the Platform

4. Prescription Medicines

Some medicines require a valid prescription from a certified doctor.

• You must upload a clear and valid prescription before such medicines are delivered.
• Pharmora has the right to verify the prescription with your doctor or the relevant authorities.
• We do not offer medical diagnosis or treatment advice.

5. How Orders Work

After placing an order, we will send your request to a nearby licensed pharmacy. You'll get updates on the order, including confirmation and delivery time. We try to deliver on time, but delays can happen due to weather, traffic, or stock issues.

6. Payments

• All payments must be made through the app or website using the approved payment methods. (Credit cards, bank transfers, QR codes, wallets, etc).
• Prices include pharmacy charges and delivery fees (where applicable).
• The delivery fee can be accessed at the checkout page.
• The payment processor is solely responsible for all payment transactions consummated on our Platform.
• If there's a pricing error, we'll inform you before processing the order.
• By creating an account, you agree to be bound by these terms of payment.

7. Delivery

• We deliver to areas where our partner pharmacies operate.
• You must be available to receive the order, or someone on your behalf.
• If the delivery fails due to wrong address or no one being available, extra delivery charges may apply.

8. Refunds and Returns

• Prescription drugs cannot be returned once delivered unless they were wrongly delivered, expired, or damaged.
• For non-prescription items, returns are allowed within 48 hours if they are unopened and undamaged.
• Refunds are processed within 5-10 business days.

9. Your Responsibilities

When using Pharmora, you agree to:

• Use the platform only for lawful purposes.
• Where we have reason to suspect or believe that there has or is likely to be a security breach or other misuse of our Platform, we reserve the right to require you to change your password. Failure to do so may result in us suspending or deleting your account.
• Not misuse or tamper with the service.
• Provide correct information and prescriptions.
• Treat Pharmora staff and pharmacy partners with respect.

10. Intellectual Property Rights

We and our Partners own all intellectual property rights in the Platform and any materials published on it. These rights are protected under applicable copyright laws in Nigeria and all such rights are reserved. You may only access and use the materials for personal use and you may not otherwise reproduce, distribute, publicly display or modify without a licence to do so from us.

11. No Reliance

The content on our Platform regarding OTC Pharmaceuticals is provided for general information only and is not intended to amount to advice on which you should rely. Although we make reasonable efforts to update the information on our site, we make no representation or guarantee, whether express or implied, that the content on our website/application is complete or up-to-date and you acknowledge that any reliance on such information will be at your own risk. Pharmora does not provide medical advice, diagnosis, or treatment. All content is for informational purposes only and not intended to substitute professional healthcare advice. Always consult your doctor or a qualified health provider regarding any medical condition.

12. Privacy and Data Use

We collect your personal and health information to:

• Process your orders.
• Deliver your products.
• Improve our services.

13. Availability of Products

Product availability depends on what our partner pharmacies have in stock. We will inform you quickly if a product is unavailable and suggest alternatives if possible.

14. Suspension or Termination

Pharmora may suspend or permanently stop your access if:

• You break the Terms.
• You provide false prescriptions or misuse the platform.
• Required by law enforcement or regulatory bodies.

15. Limitation of Liability

Important: Nothing in these terms of use excludes or limits our liability for personal injury arising from our negligence or fraudulent misrepresentation or any other liability that cannot be excluded or limited by Nigerian law.

16. Indemnification

You agree to indemnify, defend and hold Pharmora harmless against any loss, damage, liability and claim due to or arising out of your:

• Use or misuse of our Services.
• Use or misuse of the OTC Pharmaceuticals being delivered.
• Breach of these terms of use or any applicable law.

16A. Third-Party Services

Pharmora may rely on third-party service providers to deliver certain aspects of the platform's functionality, including but not limited to payment processing, mapping, analytics, and hosting services. by using the platform, you acknowledge and agree that your use of such features may also be governed by the terms and privacy policies of those third-party providers. pharmora shall not be liable for any issues arising from the use of third-party services beyond its control.com

17. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes will be resolved in Nigerian courts.
